Advice for individuals, businesses and instructing solicitors on data protection, access requests, data breaches, compliance and disputes in Ireland.
Discuss a data protection matterClear advice on personal data
David advises individuals, businesses and instructing solicitors on GDPR and data protection matters. His work includes assessing how personal data has been collected, used or disclosed, advising on access requests and compliance questions, and preparing claims and responses where a dispute arises.
Advice is considered in the context of the General Data Protection Regulation (GDPR), the Data Protection Act 2018 and the particular facts, documents and outcome sought.
How David can assist
Data subject access requests
Advice on preparing focused requests, reviewing responses, identifying missing personal data and assessing exemptions or redactions. For organisations, advice can address the scope of a request, searches, third-party information and the response process.
Data breaches and unauthorised disclosure
Assessment of incidents involving misdirected correspondence, loss of records, inappropriate sharing or access to personal data. Advice can address the evidence, the response required, potential remedies and the prospects of a claim or defence.
Employment and workplace data
Advice on personal data in personnel files, recruitment records, workplace investigations, disciplinary material, performance records and internal communications. This work can overlap with David’s employment law practice.
Compliance and advisory work
Advice on proposed data use, privacy information, lawful processing, retention, data-sharing arrangements and the handling of individuals’ rights requests. The scope is agreed around the organisation’s activities and the specific questions requiring legal advice.
Complaints, claims and dispute resolution
Advice on correspondence and complaints involving the Data Protection Commission, the evidence needed to support or respond to a concern, and appropriate next steps. In contentious matters, instructions can include opinions, pleadings, submissions, settlement discussions and court representation through a solicitor.
Making an enquiry
You can approach David directly for appropriate non-contentious advice. If a matter is already contentious or becomes contentious, a solicitor will need to be retained. David can recommend a suitable law firm to instruct him, or work with your existing solicitor. The choice of solicitor remains yours.
